This Liability Waiver and Release Agreement (“Agreement”) is entered into by and between (“Participant”) and FAMLIFE FLEX ATHLETICS LLC as of the date of this agreement and thereafter.
1. Assumption of Risk
I, the Participant, acknowledge that participation in Famlife Flex Athletics Training involves inherent risks, including but not limited to, the risk of injury, illness, or death. These risks can arise from various sources, including the nature of the activity, the environment, equipment, and the actions or inactions of other participants. I understand and voluntarily assume all such risks.
2. Release of Liability
In consideration of being allowed to participate in Famlife Flex Athletics Training, I hereby release, waive, discharge, and covenant not to sue the Organization, its directors, officers, employees, agents, volunteers, and any other participants (collectively referred to as the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action, known or unknown, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activities or while on the premises where the activities are conducted.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my participation in Famlife Flex Athletics Training and to reimburse them for any such expenses incurred.
4. Medical Treatment
I authorize the Organization to obtain emergency medical treatment for me in the event I am injured or become ill while participating in Famlife Flex Athletics Training. I understand that I am responsible for all costs associated with such medical treatment.
5. Insurance
I acknowledge that the Organization does not carry or maintain health, medical, or disability insurance coverage for me. I agree to maintain sufficient insurance coverage for any medical expenses that may arise from my participation in Famlife Flex Athletics Training.
6. Photo and Media Release
I grant the Organization permission to use my likeness in any photographs, videos, or other media taken during my participation in Training for promotional purposes, without compensation.
7. Compliance with Rules
I agree to comply with all rules, regulations, and instructions provided by the Organization and its representatives. I understand that failure to comply may result in my removal from the activity and premises.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
9. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be reformed to the extent necessary to make it enforceable.
10. Acknowledgment of Understanding
I acknowledge that I have read this Agreement, fully understand its terms, and sign it freely and voluntarily. I understand that by signing this Agreement, I am giving up substantial rights, including the right to sue the Released Parties.

I, the undersigned, as the parent or legal guardian of the Participant, hereby consent to the Participant’s participation in Famlife Flex Athletics Training. I acknowledge that I have read and understand this Agreement and agree to its terms on behalf of the Participant.
